Member Rights and Responsibilities

As a member, you have the right:

  • to be treated with dignity and respect by staff.
  • to retain all civil rights that have not been specifically curtailed by an order of the court.
  • to make complaints and offer suggestions to the director and have your suggestions and complaints heard and decided upon promptly.
  • to be helped by any advocate of your choice in asserting your rights.
  • to hire an attorney to assist you with your rights.
  • to practice the religion of your choice or to abstain from religious practices.
  • to handle your personal affairs, including making contracts, holding a driver’s license or professional license, marrying or obtaining a divorce, and writing a will.
  • to participate in development of a goal plan and to review it regularly with your care manager. This plan will be written in terms you can understand.
  • to receive treatment in the least restrictive setting necessary to accomplish treatment goals.
  • to decline participation or disenroll from ECCM.
  • not to be subjected to any harsh or unusual treatment.
  • to be informed of the nature of the material to be released when requested to sign a release of information.
  • to expect confidentiality, with the following exceptions:
    • In the case of medical or psychiatric emergencies.
    • In case of suspected child abuse.
    • In case of threats of harm to others.
    • During involuntary commitment proceedings.
    • With other mental health or medical providers involved in your care and treatment.
  • to refuse medication and/or try alternative treatments based upon your religious beliefs and practices. You have the right to request a change in medication from your doctor.

 

These rights align with the United Nations Universal Declaration of Human Rights.

As a member, you are also responsible for:

  • supplying information, to the extent possible, for provision of care.
  • understanding your plan and participating in developing mutually agreed goals and outcomes, to the degree possible.
  • following the plan and instructions for care agreed to with your team. This includes consideration of the possible consequences of failure to comply with your plan.
  • reviewing member materials carefully and reporting any questions or concerns.
  • being respectful and acting in ways that keep people safe.
